*The session fee must be paid in full at the time of booking and is non-refundable. Appointments are not considered booked until the session fee is paid and the signed contract is received electronically.
*Due to the limited number of sessions that I am able to schedule each month, all unpaid spots will go to the next client on my wait list.
*Sneak peeks will only be posted to Facebook & Instagram after payment has been received in full at the view and order session. By signing this contract, you are giving permission to BabyLove to post your sneak peek on Facebook/Instagram. If you do not wish to have any of your images posted to social media, kindly inform BabyLove as such, and your images will only be available for viewing at the view & order session.
*Newborn sessions must take place within 12 days of baby's birth as babies tend to be more alert as they get older. BabyLove cannot guarantee specific poses, as every baby is different and may/may not like a certain pose or baby may be too alert to safely do a pose.
*Albums and other products are printed overseas, and can take approximately 4-6 weeks to be delivered. BabyLove cannot be held responsible for any shipping delays from the suppliers.
*BabyLove shall not be held liable for the quality of images resulting from printing at unauthorized discount printers e.g. Wal-Mart, Walgreens, etc.
*To ensure a smooth session, it is preferred that only the parents are present during the session.
*Family mini sessions are limited to the immediate family of the newborn (i.e. mother, father, sister and brother). There will be an additional fee for extended family members.
*Clients will be presented with images that have been professionally selected and edited from BabyLove's selection of the images shot during the session. BabyLove reserves the right to make the selection of the best images to include in the gallery and does not sell/preview the unedited images. Therefore, all images from the session will not be included in the gallery.
*Additional editing (including adding text) will be charged an additional price of $2.00 per minute, which must be paid in full and upfront.
*Re-shoots are ONLY scheduled if baby is fussy/sick. Clients are given the opportunity for requested shots at the session. If client desires any additional shots at a later date, there will be an additional session fee.
*It is understood that BabyLove is the exclusive official newborn photographer retained to perform the photographic services requested in this contract.
*Upon confirmation, BabyLove shall reserve the time and date agreed upon. Unless BabyLove is able to fully replace the cancelled reservation, all sitting fees are non-refundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather or family emergency.
*If, in the opinion of BabyLove, inclement weather or other adverse conditions prevent the creation of a portrait meeting to the artistic standards of BabyLove, I may elect to use an alternate location or to reschedule the session.
*No part of any order, including previews, will be delivered until the balance is paid in full.
*Digital files and previews remain the exclusive property of BabyLove.
*In the event BabyLove is not able to provide services on your scheduled date and time due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer's illness or emergency, your session will be rescheduled or your session fees refunded. This would only be if absolutely necessary and is not expected to be a possibility.
*If BabyLove cannot perform this contract due to fire or other casualty, strike, act of God or other cause beyond the control of the parties, or due to the Photographer's illness or emergency, and the sitting fee is refunded to the client, BabyLove shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.
*In the event BabyLove fails to perform for any other reason, BabyLove shall not be liable for any amount in excess of all monies paid.
*Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and client releases BabyLove from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
*The charges in this contract are based on BabyLove's Standard Price List. This price list is adjusted periodically and all orders shall be charged at the prices in effect at the time when the order is placed.
*NOTICE OF COPYRIGHT: These photographs are the sole property of BabyLove and therefore shall not be copied or reproduced for commercial use without the written consent of BabyLove.
*This contract incorporates the entire understanding of the parties and any modifications of this contract must be in writing and signed by both parties.
*BabyLove will keep a backup copy of client's images for a period of 6 months after the date of the session and cannot be held liable for a refund or loss of images after this time due to technology failure, etc. Client is therefore responsible for downloading files for safekeeping.
